Terms & Conditions of Engagement.

We really look forward to working with you, but before we do, we just need to cross the T’s and dots the I’s. Please have a read-through of the below Terms & Conditions of Engagement, then fill out the form to confirm acceptance.

  • TERMS & CONDITIONS OF ENGAGEMENT

    All services George Design Ltd provides are subject to the following terms and conditions. In these terms and conditions of engagement, George Design Ltd is also called “George Design” or “We”. The client means the person or business accepting the terms of this engagement and is also referred to as “you” or “the client”.

    ACCEPTANCE

    You can agree to these terms and conditions by either of the following options:

    - Submitting the Terms & Conditions of Engagement online form at www.georgedesign.co.nz/terms-and-conditions

    - Signing and returning a proposal to George Design

    - Paying a project deposit

    PROJECT COST ESTIMATES AND PROPOSALS

    Before commencing work on a project, a cost estimate or fixed price quotation detailing fees will be prepared for client approval. This is based on information provided by the client at the time of quoting work. Estimates and quotations are valid for 14 days from the date on the document or email.

    Any additional work outside the original project scope will be charged at $150+gst per hour.

    There is a minimum billing time of 4 hours for new jobs ($600+gst). Additional time will be billed in blocks of 15 minutes. Costs such as hosting, digital advertising, printing, art licensing or photography will be estimated and billed to the client.

    When services are rendered on the client's premises, a daily rate of $1,450+gst shall apply.

    Additionally, travel expenses will be invoiced at a rate of:

    - $0.95 per kilometre travelled
    - $90+gst per hour travelled

    Costs such as accommodation and flight tickets will be on-billed to the client.

    DESIGN SPRINT

    Our Design Sprint service is the perfect solution for those who need custom, bespoke design in a timely manner. You are not purchasing completed deliverables but a block time for $1,880+gst.

    Payment in full will be due to GEORGE DESIGN prior to the start of work.

    PAYMENT

    Invoices are based on the project proposal. Ongoing projects will be invoiced on a work-in-progress basis on the last day of the month. A final invoice will be issued upon completion of a project. Payment is due within 7 days of the invoice. Ongoing project hourly rates

    are reviewed periodically and we will provide notification of this.

    COPYRIGHT AND INTELLECTUAL PROPERTY

    Artwork, images, website design and or strategy files created by George Design on behalf of the client, will remain the property of George Design until the client has made full payment. Once payment has been received, the client will own the rights to these completed design files.

    The client gives George Design the right to use websites and graphics created for the client, for their marketing purposes, unless the client withdraws this permission.

    Proposal presentations and videos developed for clients by George Design are for strategic internal use only. They are not to be reproduced or broadcast in any way. Some proposals may contain copyrighted images that are used as research examples for representational purposes only, without George Design having copyright clearance. The client agrees not to share any proposal presentations created by George Design in the public domain.

    IMAGES

    Any images supplied to George Design for use in a design project must be high resolution and accompanied by appropriate written approval of the photographer. George Design will not be responsible for any legal issues or copyright breaches as a result of the use or printing of supplied images. George Design can source high-resolution stock images with the correct commercial license rights on your behalf, George Design requires full payment prior to approved images being downloaded.

    PROOFING AND APPROVAL

    Artwork is typically produced using client-approved copy. Although every care is taken with the handling and checking of content, errors can occasionally occur. It is the client’s responsibility to check and approve final proofs. These must be signed or otherwise evidenced as verified and the original proofs returned to George Design prior to production commencing.

    George Design is not liable for errors or variations in the finished work where such errors or variations were contained in the proof approved by the client.

    FILE SUPPLY

    Logo files are supplied electronically to the client in print and web-friendly formats. Print files will be supplied as high resolution PDFs with crop marks and bleed. If other file types are required please specify when asking for a quote, if unsure of file type required please explain your planned use. All original source/working files remain the property of George Design unless otherwise arranged.

    FILE STORAGE

    It is recommended that you download and store any files sent to you in your own secure Cloud storage system. Any links to files sent to you are temporary and purely for you to gain access to your files. George Design is not liable if you lose files we create and send to you after project completion.

    PRIVACY

    Your privacy is important. George Design respects your privacy and personal details. Any information supplied to George Design during the design process will be solely used for that purpose and not disclosed to any third parties without written consent of the client. You have the right to request access to any personal information held by us about you.

    SUBCONTRACTORS

    George Design reserves the right to hire subcontractors on any given project should the need arise.

    PROJECT OR CONTRACT TERMINATION

    You may cancel the contract at any time. George Design reserves the right to cancel this contract for non-payment, and if the contract is cancelled for non-payment all work produced for the client remains the property of George Design. If a project is terminated, all fees and disbursements incurred up to the date of termination will be calculated and invoiced to the client. Where George Design has built a website for the client, George Design reserves the right to remove the client’s website from the marketplace until such time as any overdue debts are paid in full.

    George Design reserves the right to charge a late fee of 5% on any amount not paid in full by the due date. The client is liable for all debt collection costs, including legal expenses, incurred in recovering debts owed to George Design.
